This is a common question foreigners ask when starting a search for property in Portugal. The short answer: Yes.
This article explains why legal assistance is essential for foreigners buying property in Portugal.

Purchasing real estate in Portugal can be an exciting opportunity, but for foreigners, the process can quickly become complex due to unfamiliar legal frameworks and regulations. Here’s why hiring a real estate lawyer is essential:
Understanding Local Laws: Portuguese property laws are unique and often complicated. A local lawyer ensures compliance with all regulations, helping you avoid legal issues.
Protecting Against Fraud: Foreign buyers are vulnerable to scams or illegal properties. A lawyer verifies property titles, ensures proper documentation, and protects you from dishonest sellers or agents.
Navigating Bureaucracy: Portuguese bureaucracy is notorious for its complexity. Lawyers assist in dealing with municipal permits, licenses, and other legal processes that may delay or even jeopardize your property purchase.
Reviewing Contracts: Contracts are typically in Portuguese, filled with legal jargon. Your lawyer ensures that the terms are fair and that you fully understand your rights and obligations.
Due Diligence: Lawyers perform comprehensive due diligence, from checking land registry to verifying tax compliance, ensuring that there are no hidden liabilities or encumbrances on the property.
Handling Negotiations: Lawyers can negotiate on your behalf, ensuring that you’re getting the best deal possible while safeguarding your legal interests.
Post-Sale Legal Support: After the purchase, legal issues can still arise, such as taxes, disputes with neighbors, or inheritance laws. Your lawyer provides ongoing support and advice.
Conclusion:
It is risky for foreigners to navigate Portugal's real estate market without legal assistance. A real estate lawyer guarantees a secure and legally compliant transaction, protecting your investment and providing peace of mind.
Personal story:
We purchased four plots of land which were owned by seven different families. Each plot was inherited. As we were preparing the documentation for the promissory contract, our lawyer noticed that one of the heirs was a minor, and because of this, we had to wait until her 18th birthday to close on the property. If everyone had signed off on the sale, while the girl was still a minor, she would have been able to come back and claim her property until her 19th birthday. The wait for her birthday was six months. So, we waited.. Luckily for us, we were not pressed for time.
